[Uniq Physique ltd] – Membership Terms and Conditions

These Terms and Conditions (“Terms”) govern the relationship between [Uniq Physque ltd] (“the Gym”, “we”, “us”, “our”) and the individual whose details are provided at the point of registration (“the Member”, “you”, “your”). By applying for membership and/or using the Gym’s facilities, you agree to be bound by these Terms.

1. Membership and Access

1.1 Memberships are personal to the Member and are non-transferable.
1.2 All Members must be at least 14 years of age unless otherwise agreed in writing.
1.3 Access to the Gym shall be via the Gym’s mobile application and unique QR code. Access credentials must not be shared with, or transferred to, any other individual.
1.4 The Gym reserves the right to refuse, suspend, or terminate membership at its sole discretion if these Terms are breached.

2. Health and Safety

2.1 The Member confirms that they are in good health and physically capable of engaging in exercise. The Member agrees to complete a Physical Activity Readiness Questionnaire (PAR-Q) truthfully and update the Gym of any changes in health status.
2.2 The Member must use equipment in a safe and proper manner and follow all instructions provided by staff.
2.3 The Member agrees to comply with all posted safety notices and emergency procedures.
2.4 The Gym shall not be liable for any injury or illness arising from the Member’s use of facilities unless directly caused by the Gym’s negligence.

3. Conduct and Use of Facilities

3.1 The Member must conduct themselves in a respectful and courteous manner towards staff and other Members. Abusive, disruptive, or unsafe behaviour will not be tolerated and may result in immediate termination of membership.
3.2 Suitable clothing and footwear must be worn at all times.
3.3 Cubby holes are provided for day use only. The Gym accepts no liability for loss, theft, or damage to personal belongings.
3.4 The Gym may temporarily close or restrict access to facilities for maintenance, cleaning, events, or reasons beyond its control.

4. Guests and Visitors

4.1 The Gym may, at its discretion, permit Members to bring guests. Guest access is subject to payment of the applicable fee and completion of a guest waiver.
4.2 The Member is responsible for ensuring that any guest complies with these Terms.

5. Minors and Children

5.1 Members under the age of 14 are not permitted to use the facilities unless expressly authorised by the Gym in writing.
5.2 Where authorisation is granted, minors must be accompanied and supervised by a parent, guardian, or approved trainer at all times.
5.3 The Gym reserves the right to impose additional restrictions on minors’ access to specific equipment or areas.

6. Photography and Media

6.1 From time to time, the Gym may take photographs or videos within the premises for marketing and promotional purposes.
6.2 The Member consents to the incidental inclusion of their image in such material. If the Member does not wish to appear in photographs or videos, they must notify the Gym in writing.
6.3 Members must not film or photograph other Members without their express consent.

7. Fees and Payment

7.1 Membership fees are payable in advance by direct debit, standing order, or other agreed method.
7.2 Failure to make payment may result in suspension or termination of membership.
7.3 Membership cancellations must be submitted in writing with a minimum of 30 days’ notice.
7.4 No refunds will be issued for non-use of facilities.

8. Data Protection

8.1 The Gym will collect, store, and process Member personal data in accordance with applicable data protection laws, including the UK General Data Protection Regulation (GDPR).
8.2 Member information will be used for administration, safety, and communication regarding Gym services only, unless explicit consent is obtained for other uses.
8.3 Members may request access to, rectification of, or deletion of their personal data at any time.

9. Liability

9.1 The Member acknowledges that the use of Gym facilities and participation in physical exercise involves inherent risks.
9.2 The Gym shall not be liable for any injury, illness, loss, or damage sustained by the Member or their property, except where directly caused by the Gym’s negligence.
9.3 The Member uses the facilities at their own risk.

10. Variation of Terms

10.1 The Gym reserves the right to amend these Terms at any time.
10.2 Members will be notified of material changes via the Gym’s app, email, or notice within the premises. Continued use of the facilities after such notification shall constitute acceptance of the amended Terms.

11. Governing Law

11.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales.
11.2 The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms.
